owner of the soil (Damage feasant – Doing hurt or damage (Fr. faisant); that is when one man’s beasts are in another man’s ground without license of the tenant of the ground and there do seed, tread, and otherwise spoil the corn, grass, woods, and such-like. In this case the owner of the soil may distress them (ie take possession of them) until satisfaction be made him for the injury he has sustained –JBS( ● freeholder : One having title to realty; either of inheritance or for life; either legal or equitable title. A person who possesses a freeholder estate, ie the owner of a freehold.
